These Terms & Conditions govern use of Simplicity CRM, a software platform owned and operated by Dlee Investments LLC. By accessing or using Simplicity CRM you agree to these Terms on behalf of yourself and the agency you represent.

Platform terms

Simplicity CRM provides lead intake, customer and policy records, retention and servicing workflows, carrier data import, task management, and agency communications. We may add, modify, or discontinue features over time. Access is granted to identified agency users only.

Acceptable use

You agree not to misuse the platform, including attempting unauthorized access, interfering with service operation, probing or scraping, reverse engineering, uploading unlawful or infringing content, or using the platform to send communications that violate applicable law, carrier rules, or messaging-provider requirements.

User responsibilities

You are responsible for the accuracy of your account information, for safeguarding credentials, for activity performed under your account, and for the accuracy of data you enter. Do not share logins between individuals.

Insurance agency responsibilities

Each agency is responsible for its own licensing, appointments, carrier agreements, disclosure obligations, recordkeeping, and supervision of its staff. Agencies are responsible for obtaining and documenting consumer consent before sending communications and for honoring opt-out requests.

No guarantee of insurance availability, pricing, eligibility, or coverage

Simplicity CRM is not an insurance carrier, agency, or producer, and does not underwrite, bind, quote, or sell insurance. Nothing in the platform guarantees that insurance is available, that any particular price or discount applies, that an applicant is eligible, or that coverage is or will remain in force. Coverage determinations are made solely by the applicable carrier under its own policy terms.

Platform availability

We aim for high availability but do not guarantee uninterrupted access. Maintenance, updates, third-party outages, and factors beyond our control may affect availability.

Intellectual property

The platform, its software, design, and documentation are the property of Dlee Investments LLC and are protected by intellectual property law. These Terms grant a limited, revocable, non-exclusive right to use the platform and do not transfer ownership of any part of it.

Data responsibility

Your agency retains ownership of the data it enters or imports and grants Dlee Investments LLC a limited license to process that data solely to provide and support the platform. You are responsible for having the rights and consents needed for the data you upload, including consumer contact information and messaging consent.

Communications

Any SMS, email, or voice communication sent through the platform is initiated by your agency, from your agency's registered sending identity. Your agency is responsible for complying with the TCPA, CAN-SPAM, applicable state law, and carrier and messaging-provider policies, including consent capture, disclosure, and opt-out handling.

SMS Messaging Terms

By providing consent to receive SMS communications, recipients agree to receive text messages related to insurance inquiries, quote follow-up, policy servicing, payment reminders, document requests, underwriting updates, renewal and retention communications, customer service, and other communications for which consent has been provided.

Message frequency varies based on customer activity and insurance needs.

Message and data rates may apply.

Consent to receive SMS messages is not a condition of purchasing insurance or any other product or service.

Recipients may reply STOP at any time to unsubscribe from SMS communications.

Recipients may reply HELP for assistance.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Carriers are not liable for delayed or undelivered messages.

Limitation of liability

The platform is provided “as is” and “as available” without warranties of any kind to the fullest extent permitted by law. Simplicity CRM does not provide legal, compliance, tax, or insurance advice. To the maximum extent permitted by law, Dlee Investments LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business opportunity.

Changes to terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Continued use of the platform after an update constitutes acceptance.

Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.
